Form to brief the traveler on a package holiday according to § 65A1 of the civil code
The offered combination of travel services is a package holiday within the meaning of the directive (EU) 2015/2302.
Therefor you are able to make demands on all EU-rights, which apply to package holidays. The Severin Touristik GmbH bears the whole responsibility for the correct realization of the package holiday. Furthermore, the corporation has the statutory protection for the repayment of your payments and, if the transport is included in the package, to ensure your return in case of bankruptcy.
Most important rights under the directive (EU) 2015/2302
The travelers will receive all essential information about the package before the contract is concluded. At least one operator is always liable for the correct provision of all the services which are included in the contract.
Passengers get an emergency number or information to a contact point, where they can connect with the tour operator or the travel agency. Passengers are able to transfer the journey to another person in a reasonable time and, if necessary, at additional costs.
The price of the package holiday is only allowed to be raised if certain costs (for example fuel prices) increase and it is explicitly intended in the contract and in any case 20 days before the start of the package holiday at the latest.
If the increase in price exceeds 8% of the package price, the passenger is allowed to withdraw from the contract. If a tour operator reserves the right to a price increase, the traveler has the right for a price reduction if the corresponding costs decrease. The passengers can withdraw from the contract even without paying a cancelation insurance, and get all the money back, when one of the constituents of the package holiday, with the exception of the price, are changed considerably. If the operator of the package holiday cancels the tour prior to departure, the passengers are entitled to a refund and possible compensation.
Furthermore, the passengers can withdraw from the contract before the beginning of the journey by paying an appropriate compensation anytime. If constituents of the package holiday cannot be executed after the beginning, the tour operator has to offer the passengers similar proposals without extra costs. The passenger is allowed to withdraw from the contract without paying any charge (in the Federal Republic of Germany this right is called termination), if services are not provided in accordance with the contract and this has a significant impact on the provision of the contractual package tour services and the tour operator fails to remedy the situation. The passenger is eligible for a price decrease and/ or compensation, if the journey services aren´t performed or not performed properly.
The tour operator assists the passenger if he is in trouble.
In case of bankruptcy of the tour operator or of the travel broker in some member states, payments have to be refunded. If the bankruptcy of the tour operator or the travel broker occurs after the beginning of the package holiday, the return transfer of the passenger has to be warranted, when the transport is a part of the contract. Severin Touristik GmbH has concluded a bankrupt-insurance with the HDI insurance.
